Premarital Agreements

Pre-marital agreements are a combination of divorce and estate planning. With fifty-percent of marriages ending in divorce, that may be a pragmatic approach. The law provides a framework for a premarital agreement that resolves issues like property division and alimony upon death or divorce. For a valid agreement, there must be full disclosure of assets and debts. Generally both parties must be represented by legal counsel for a valid and enforceable agreement.

Premarital agreements can also be a foundation for predicting and resolving conflicts before they drive the marriage asunder.

As divorce lawyers, we've seen how divorce sometimes comes from small differences that persist over time, festering, and eventually exploding. Some couples get married thinking they'll work out their differences, that love is enough. But when the difference is core to the relationship-whether to have children, where to live, etc.--the differences often don't resolve without help.

Even after marriage, we can work with couples to create post-nuptial agreements, resolving conflict over different attitudes about money, child-rearing, and other issues BEFORE divorce seems the only option.
